PetitDame Terms and Conditions

These terms and conditions apply to all offers made, orders placed and contracts concluded through PetitDame’s online store.

Article 2 – Applicability

  1. These terms and conditions apply to every offer made by PetitDame and every contract concluded through the online store.

  2. By placing an order, the consumer agrees to these terms and conditions.

  3. Any deviations from these terms and conditions are valid only if agreed in writing.

Article 3 – Offers and products

  1. PetitDame takes the utmost care in describing its products.

  2. Images are provided for illustrative purposes. Colours may vary depending on screen settings.

  3. Obvious errors or mistakes in prices or product information are not binding.

  4. PetitDame reserves the right to remove products from its range or make changes.

Article 4 – Formation of the contract

  1. A contract is formed when the consumer places an order and PetitDame confirms it by email.

  2. PetitDame reserves the right to refuse an order in the event of an obvious error, fraud or incorrect information.

Article 5 – Prices

  1. All prices shown include VAT.

  2. Any discounts and promotions are temporary and may be changed without prior notice.

  3. Obvious pricing errors do not entitle the consumer to delivery at the incorrect price.

Article 6 – Payment

Payment must be made using one of the payment methods offered at checkout.

PetitDame reserves the right to dispatch an order only after full payment has been received.

Article 7 – Delivery

  1. PetitDame aims to deliver within the stated delivery time.

  2. Exceeding the stated delivery time does not entitle the consumer to compensation.

  3. Some products are delivered in multiple packages due to their size or weight.

  4. The risk of damage or loss passes to the consumer only once the order has actually been delivered.

Article 8 – Shipping costs

No shipping costs are charged for delivery within the European Union, unless otherwise stated.

Article 9 – Right of withdrawal

  1. The consumer has the statutory right to withdraw from the contract within 14 days without giving a reason.

  2. PetitDame also voluntarily offers a return period of 30 days after receipt.

  3. During the cooling-off period, the product must be handled with care.

  4. The product may be used only to the extent necessary to establish its nature, characteristics and functioning.

Article 10 – Returns

Returns can be registered by emailing info@petitdame.nl.

After registering a return, the consumer will receive return instructions.

Return shipping is free of charge, provided the conditions of PetitDame’s returns policy are met.

Article 11 – Refunds

The purchase amount will be refunded no later than 14 days after receipt of the returned goods, using the same payment method.

Article 12 – Exceptions to the right of withdrawal

The right of withdrawal does not apply to:

  • Personalised products;

  • Products that cannot be returned for hygiene reasons once their seal has been broken;

  • Digital products for which delivery has begun immediately with the consumer’s consent.

Article 13 – Statutory guarantee

All products meet the statutory requirements for quality and conformity.

If a product proves to be defective, the consumer is entitled to a repair, replacement or appropriate remedy free of charge in accordance with the statutory guarantee.

Article 14 – Complaints

Complaints can be submitted by emailing info@petitdame.nl.

PetitDame aims to provide a substantive response to every complaint within 5 working days.

If a complaint cannot be resolved by mutual agreement, the matter may be referred to the Dutch court with jurisdiction.

Article 15 – Liability

PetitDame is liable only for direct loss or damage resulting from wilful misconduct or gross negligence.

Nothing in these terms and conditions limits consumers’ statutory rights.

Article 16 – Privacy

Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and PetitDame’s privacy policy.

Article 17 – Intellectual property

All texts, images, logos and other content belonging to PetitDame are protected by copyright and intellectual property rights.

Reproduction or publication without written permission is prohibited.

Article 18 – Force majeure

PetitDame is not required to fulfil its obligations if these cannot reasonably be performed due to force majeure, including disruptions, transport problems, war, pandemics, natural disasters or government measures.

Article 19 – Amendments

PetitDame reserves the right to amend these terms and conditions.

Contracts already concluded remain subject to the terms and conditions that applied when the order was placed.

Article 20 – Applicable law

All contracts between PetitDame and the consumer are governed exclusively by Dutch law.

Disputes shall be submitted to the court with jurisdiction in the Netherlands, unless mandatory legal provisions require otherwise.
